I am invovled in a federal lawsuit where I am the plaintiff and a county civil action where I am the defendant. Can I have the county case set aside until the fedral case is done? Also which legal statute would apply in this matter?Do federal civil court cases take precedence over state or county civil cases?
If the federal case takes precedence would depend on what the cases are about, under what theories the action is being brought, the standard of proof in each, etc. This can go either way with the state taking precedence over federal or Visa versa. Its called res judicata. Basically once an issue has been decided you cant go to another court in another jurisdiction and try to get a different outcome. But if there are even slightly different issues being decided it probably wont apply, this sound like this may be the case since you are plaintiff for one and defendant in another. Under your local rules you may be able to petition the court to set aside the county/federal case if a decision in one would render a decision in the other unnecessary but this is up to a court to decide and probably isn't likely. If you're involved in all that litigation your attorney(s) should know the sequencing for the cases! If you're doing it yourself...look it up.
